These Terms and Conditions govern your use of Fottory, which generates dating photos from your own selfies, checks photos you already have, and helps you write your profile. By using any part of it, including the free photo check, you agree to these terms. If you do not agree, please do not use the service.

1. Who we are

Fottory is operated by a company of the same name registered in the Netherlands (in these terms, "Fottory", "we", and "us"). To reach us about these terms, email info@fottory.ai.

2. Who can use Fottory

You must be at least 18 years old to use Fottory. The service is built for adult dating profiles, and you confirm you are 18 or older each time you use it.

3. What Fottory does

Fottory does three things, and you can use any of them on their own.

• It generates photos. You upload a few photos of yourself, choose the look you want, and Fottory generates new photos of you in different scenes and outfits. The results are meant to look like you.
• It checks photos you already have. You upload up to six, and Fottory judges each one on its own: a verdict, the place it could fill on a profile, and findings written about that photo. The findings are statements about the image, such as its resolution or that the light hides the face. They are not a rating of you, and Fottory does not produce a score for your appearance, your attractiveness, or your trustworthiness.
• It helps you write. You give Fottory facts about yourself, and it drafts a bio and answers to profile questions using only those facts. Every line is checked against what you supplied before you see it.

Fottory is a tool. It does not promise any particular number of matches, dates, or messages, and nothing it writes or generates is advice about how you should present yourself.

4. Your account and your photos

You are responsible for the photos you upload and for how you use the photos Fottory generates for you. This applies to every photo you upload, whether you are generating new ones or asking us to check ones you already have.

• You may only upload photos of yourself, or of someone aged 18 or over who has given you clear permission to use their face. Do not upload photos of anyone else. The photo check is not an exception to this: uploading a photo of somebody else to have it analysed, even without generating anything from it, is not allowed, and it is your responsibility to be sure you have the right to upload each photo you send.
• You confirm that you own or have the right to use every photo you upload, and that using it with Fottory does not break the law or anyone else's rights.
• You keep ownership of the photos you upload and of the photos Fottory generates for you.
• You give us permission to process your photos only to run the service and create your results. We do not use them for anything else. See our Privacy Policy for the detail.
• You are responsible for keeping your login details safe.

5. Credits, free photos, and billing

• Your first 2 photos are free, and you do not need a card to try them.
• After that, you buy a one-time pack of credits. There is no subscription, and nothing renews on its own.
• You spend a credit when you ask for a photo. Choosing scenes and outfits is free until you generate.
• Prices are shown in euros, US dollars, or British pounds, based on the country we detect from your IP address. The price shown at checkout is the price you pay. Taxes may be added where they apply.
• Payments are handled by a third-party payment provider. We do not see or store your full card number.

6. Your 14-day right of withdrawal

If you live in the EU or the EEA, you normally have 14 days to withdraw from a purchase of digital services and get your money back.

Because Fottory generates your photos straight away, when you start generating you are asking us to begin during that 14-day period, and you accept that you lose the right of withdrawal for any photo that has already been generated. You keep the right to withdraw for credits you have bought but have not yet used.

This is why the first 2 photos are free: you can see the quality before you pay anything.

7. Refunds

Credits you have already used to generate photos are not refundable — the photo is made and delivered the moment you generate it. This is why the first 2 photos are free: you can see the quality before you pay for anything.

Credits you have bought but not yet used are refundable within 14 days of purchase. We refund their full value minus a flat €5 processing fee (the same amount in your currency: €5, £5, or $5), which covers the payment costs. Email us at info@fottory.ai from your account address and we will process it within 7 days.

None of this takes away the consumer rights you have under the law where you live, including the right of withdrawal above.

8. Using your photos and your written profile

The photos Fottory generates are yours to use, including on dating apps and for other personal or commercial purposes. So is anything it writes for you. Fottory, its software, its design, and its name stay ours.

9. The photo check

The photo check is free and has its own limits and its own retention.

• You can send up to six photos in one check, and Fottory analyses up to twelve photos a day. The daily limit is per account, counted across every check you run.
• The check needs a free account. The set and its findings are kept with it so the page opens on them next time, and they stay until you ask us to delete them.
• The findings are produced by software and by an AI model reading the image. They describe the photograph, not the person in it. They can be wrong, they are not a professional opinion, and nothing in them is a judgement about how you look.
• The check is offered as it is and may change, pause, or stop. It costs nothing, so nothing in it is refundable.

10. Help writing your profile

• Fottory writes only from facts you give it. It does not research you, and it is built so that it cannot state something about you that you did not supply.
• You are responsible for what you publish. Read every line before you use it, and check that it is true of you. Anything Fottory drafts is a suggestion until you accept it.
• If the facts you supply are wrong, what Fottory writes from them will be wrong too. A profile that does not match reality is your responsibility, not ours.
• Written suggestions are generated by an AI model and are subject to the same daily limits and the same acceptable use rules as everything else here.

11. Acceptable use

Fottory makes real photos of real people, and that is the only thing it is for. You agree not to use it to create, upload, or share:

• sexual, nude, or sexually suggestive content of any kind,
• any content involving a person under 18. You may only upload photos of adults, and sexual content involving a minor is never allowed, under any circumstances,
• photos of a real person who has not given you clear permission, or any image built to look like a real person without their consent (a deepfake),
• content that impersonates someone else, or that is meant to deceive, defraud, catfish, or mislead people about who you are,
• hateful, harassing, threatening, violent, or discriminatory content,
• anything illegal, or anything that breaks another person's rights, including their privacy or their intellectual property,
• attempts to break, copy, scrape, resell, or overload the service, or to get around its safety limits.

We may remove content and suspend or close your account if you break these rules. Where the law requires it, we will report illegal content, including any sexual content involving a minor, to the authorities.

12. Your promises and indemnity

You are solely responsible for the photos you upload and for how you use the photos Fottory generates. When you use Fottory, you promise that:

• the photos you upload are of you, or of someone who has given you clear permission,
• you own or have the right to use those photos,
• your use of Fottory, and of the photos you receive, follows these terms and the law.

You agree to defend, indemnify, and hold harmless Fottory and the people who work for it against any claim, loss, liability, damage, or cost, including reasonable legal fees, that arises from the photos you upload, the way you use the photos we generate, your breach of these terms, or your breaking of any law or anyone else's rights. This responsibility stays with you even after you stop using Fottory.

13. The service is provided as is

We work hard to keep Fottory running and to make the results good, but we provide the service "as is". Results vary from person to person and depend on the photos you upload. We do not guarantee matches, replies, or dates, and we may change, pause, or stop features over time.

14. Our liability

As far as the law allows, Fottory is not liable for indirect or unexpected losses that follow from using the service. Nothing in these terms limits any liability that cannot be limited by law, including your rights as a consumer.

15. Privacy

How we handle your photos and other personal data is explained in our Privacy Policy. In short: we never train AI models on your photos, and we never sell or share them.

16. Changes to these terms

These rules may change in future. When we update them, we will change the date at the top of this page. If a change is important, we will try to tell you. Continuing to use Fottory after a change means you accept the new terms.

17. Governing law

These terms are governed by the laws of the Netherlands. If you are a consumer in the EU or the EEA, you also keep the protections of the mandatory consumer law of the country where you live.
